Is a written lease required in Alberta?
Under Alberta's Residential Tenancies Act, a tenancy agreement can be written, verbal or implied, but the provincial government recommends a written one because it is evidence if there is a dispute. Unlike British Columbia, Ontario or Manitoba, Alberta has no mandatory government lease form, so a generator like this one is a sensible way to produce a thorough agreement.
A good agreement includes the date, the names and addresses of all parties, the rental address, the term, the rent and when it is due, the deposit, who is responsible for care and repairs, and any rules about pets, guests and fees. Both parties should sign it, and each should keep a copy. Terms that conflict with the Act cannot be enforced.
Security deposits in Alberta
A security deposit cannot be more than one month's rent at the time the tenancy starts, and it cannot be increased during the tenancy for any reason. Landlords must hold the deposit in an interest-bearing trust account in Alberta within two banking days of collecting it, and they must pay at least the minimum interest set by regulation. The rate is currently 0.0 per cent for 2026.
When the tenancy ends, if there are no deductions the landlord must return the deposit with interest within 10 days after the tenant gives up possession. If there are deductions, the landlord must within 10 days either return the balance with a statement of account or provide an estimate of deductions, with a final statement within 30 days. A landlord cannot deduct for damage or cleaning if move-in and move-out inspection requirements were not met. The government pages do not say whether a separate pet deposit counts toward the one-month cap, so this generator does not add one; if you want something extra, discuss it carefully and keep the total within the limit.
Rent increases in Alberta
Alberta has no cap on the amount of a rent increase, but it controls timing. Rent cannot be increased until at least 365 days have passed since the last increase or the start of the tenancy, whichever is later, and not at all during a fixed term. For a periodic tenancy the landlord must give written notice that shows the date, the effective date of the increase and the landlord's signature: 12 full tenancy weeks for week-to-week tenancies, three full tenancy months for month-to-month tenancies and 90 days for other periodic tenancies.
If a landlord wants rent to rise on a fixed-term lease, the agreement must wait until the term ends, so tenants who prefer certainty often choose a fixed term.
Ending a tenancy and entering the unit
Notice to end a periodic tenancy must be in writing, include the rental address and the end date, and be signed. A weekly tenancy needs one full tenancy week from either side. For a monthly tenancy the tenant gives one full tenancy month and the landlord gives three full tenancy months, and the landlord must state their reasons. For a yearly tenancy the tenant gives 60 days and the landlord 90. A fixed-term tenancy simply ends on the date in the agreement, with no notice needed, although it is wise to tell each other early whether you plan to renew.
Without the tenant's consent, a landlord must give written notice at least 24 hours before entering, except in an emergency or where they reasonably believe the tenant has abandoned the unit. Tenants who want to sublet or assign need the landlord's written consent, which cannot be refused without reasonable grounds; the landlord has 14 days to respond with reasons and cannot charge a fee.
Who is this Alberta lease template for?
It suits private landlords, small property managers and tenants arranging a roommate or sublease who want a tidy, professional agreement without paying a lawyer or a subscription. Disputes can be taken to the Residential Tenancy Dispute Resolution Service (RTDRS), which is a faster and cheaper route than court for many matters.
